Terms of Service

FallinsPro ("FallinsPro", "we", "us") is operated by Abraham Garcia. These Terms of Service form the agreement between you and FallinsPro for your use of the FallinsPro website, AI game builder, editor, hosting and publishing features (the "Service"). By creating an account or continuing to use the Service you agree to these terms. If you do not agree, please stop using the Service.

1. Who may use the Service

You must be of legal age to enter a contract in your country, or have the consent of a parent or guardian. If you use the Service on behalf of a company or organisation, you confirm you have authority to bind it to these terms.

2. Your account

• You must provide accurate account information and keep it up to date.
• You are responsible for keeping your password and sign-in methods confidential, and for all activity that happens under your account.
• Tell us promptly at support@fallinspro.dev if you believe your account is compromised.

3. What the Service provides

FallinsPro lets you describe a game in plain language, generate HTML, CSS and JavaScript game code with AI assistance, edit that code, upload images and other assets, draw artwork, preview and test your game in the browser, save versions, and publish a playable page. Your projects are private to your account unless you choose to publish them.

4. Licence and ownership

We grant you a limited, non-exclusive, non-transferable right to use the Service within the plan you have selected. We retain ownership of the Service itself and all related intellectual property, including our software, interface, documentation and branding.

You keep ownership of the game content, code, prompts and assets you create or upload ("Your Content"). You grant us a limited licence to host, store, process, display and transmit Your Content solely so we can operate the Service and, where you choose to publish, serve your game to players.

5. AI-generated content

• You are responsible for the prompts you submit, for how you use the generated output, and for confirming you hold the rights to any content you input.
• AI output may be inaccurate, incomplete or insecure. Review, test and verify generated code before publishing or relying on it. The Service is not a substitute for professional, legal, medical or financial advice.
• You may not use the AI features to produce illegal content, sexual content involving minors, hate speech, harassment, deceptive deepfakes of real people, malware or code designed to attack systems, or to attempt to bypass our safety limits ("jailbreaking").
• Similar output may be generated for other users. We make no claim of exclusivity over AI output and do not warrant that output is free of third-party rights.

6. Acceptable use

You must not:

• use the Service unlawfully or to infringe anyone's intellectual property or privacy;
• upload or publish malware, spam, fraudulent material or unlawful content;
• interfere with the security or integrity of the Service, probe or scan our systems, scrape at scale, or circumvent technical or plan limits;
• reverse engineer, resell or redistribute the Service;
• impersonate others or misrepresent your affiliation.

7. Content moderation and rights complaints

We may review, filter, restrict, unpublish or remove content that breaches these terms, and may refuse or block AI outputs. If you believe content on FallinsPro infringes your rights, email support@fallinspro.dev with details of the content and your claim; we will investigate and remove infringing material where appropriate. Accounts responsible for repeated infringement may be terminated.

8. Payments, subscriptions and taxes

Building is free. A paid plan unlocks public publishing and related features. Plans renew automatically for the period you choose until cancelled.

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, currency, tax, invoicing, cancellation and refund mechanics are governed by Paddle's Checkout Buyer Terms. See our Refund Policy for how refunds work.

If a renewal payment fails, we keep your publishing access for one month so you can update your card; after that, published games are taken offline until payment succeeds. Cancelling ends publishing access straight away. Your projects stay saved in your account either way.

9. Service availability

We work to keep FallinsPro available and reliable, but we do not guarantee uninterrupted or error-free operation. Features may change, and maintenance, third-party outages or AI provider limits may affect availability.

10. Suspension and termination

We may suspend or terminate your access for material breach of these terms, non-payment, suspected fraud or security risk, or repeated or serious policy violations. You may close your account at any time. On termination you may export your project files for a reasonable period, after which we may delete your data.

11. Warranties and liability

To the fullest extent permitted by law, the Service is provided "as is" and we disclaim all implied warranties, including merchantability and fitness for a particular purpose. We are not liable for indirect, consequential or special losses, including lost profits, lost data or lost goodwill. Our total liability is limited to the fees you paid in the twelve months before the claim. Nothing in these terms excludes liability for fraud, death or personal injury where that exclusion is not permitted by law.

12. Indemnity

You agree to indemnify us against claims, losses and costs arising from Your Content, your unlawful use of the Service, or your breach of these terms.

13. Changes, assignment and law

We may update these terms; material changes will be announced in the app or by email. You may not assign these terms without our consent; we may assign them as part of a merger, acquisition or reorganisation. Neither party is liable for failure to perform caused by events beyond reasonable control. These terms are governed by the laws of the State of New York, United States, and the courts of that jurisdiction have exclusive jurisdiction, subject to any mandatory consumer rights in your country of residence.
